1. Agreement to Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you”) and Buzz Treats - Spiked Scoops & Frosted Shaves(“we,” “us,” “our”) governing your use of our website, mobile experience, and online ordering platform (collectively, the “Service”). By placing an order or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to place an order or create an account. By using the Service, you represent and warrant that you meet this requirement.

3. Orders & Acceptance

• Placing an order constitutes an offer to purchase. All orders are subject to acceptance by Buzz Treats - Spiked Scoops & Frosted Shaves and confirmation of item availability.
• We reserve the right to refuse or cancel any order at our sole discretion, including due to pricing errors, suspected fraud, or stock unavailability.
• Order confirmation does not constitute acceptance until the order is actively being prepared.
• Menu items, descriptions, and prices are subject to change without notice.

4. Pricing & Payment

• All prices are displayed in the local currency and are inclusive of applicable sales tax unless otherwise stated at checkout.
• An online processing fee may be applied to cover platform and operational costs. This fee is disclosed in the order summary prior to payment.
• Payment for card transactions is authorised at the time of order. You agree that we may charge the payment method provided for the total amount displayed at checkout, including any applicable taxes, fees, tips, and delivery charges.
• Cash payment (where available) is collected at the time of pickup. Failure to pay upon collection may result in account suspension.
• Promotional codes, gift cards, and loyalty point redemptions are subject to their individual terms, cannot be exchanged for cash, and may not be combined unless expressly permitted.

5. Delivery & Pickup

• Estimated preparation, pickup, and delivery times are provided as good-faith estimates and are not guaranteed. Actual times may vary due to demand, weather, or operational factors.
• Delivery is provided through third-party partners (e.g., DoorDash Drive, Uber Direct). Buzz Treats - Spiked Scoops & Frosted Shaves is not liable for delays, damages, or losses caused by delivery partners once the order leaves our premises.
• You are responsible for providing a complete and accurate delivery address and ensuring someone is available to receive the order. Failed deliveries due to incorrect address or unavailability are non-refundable.
• Delivery fees are calculated based on distance and demand and are displayed before checkout. Delivery availability is subject to geographic limitations.

6. Cancellations & Refunds

• You may request cancellation before the order is confirmed by the restaurant. Once preparation has begun, cancellation may not be possible.
• Refunds for eligible cancellations will be issued to the original payment method within 5–10 business days. Processing times may vary by financial institution.
• If you receive an incorrect, incomplete, or unsatisfactory order, contact us within 24 hours for resolution. We may offer a refund, credit, or replacement at our discretion.
• Tips, once processed, are non-refundable as they are paid directly to staff.
• Repeated fraudulent refund requests may result in account termination.

7. Accounts & Loyalty Programme

• You may place orders as a guest or create an account. Account holders benefit from saved details, order history, and loyalty points.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Loyalty points are earned on eligible purchases at the rate determined by Buzz Treats - Spiked Scoops & Frosted Shaves and may be redeemed for discounts subject to minimum thresholds and maximum redemption percentages.
• Loyalty points have no cash value, are non-transferable, and may expire or be forfeited if your account is terminated for cause.
• We reserve the right to modify, suspend, or terminate the loyalty programme at any time with reasonable notice.

8. Intellectual Property

All content on this platform — including but not limited to text, graphics, logos, images, menu descriptions, software, and design — is the property of Buzz Treats - Spiked Scoops & Frosted Shavesor its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorised access to our systems or other users' accounts
• Submit false information, including fraudulent payment details or fictitious identities
• Interfere with or disrupt the Service, servers, or networks
• Engage in abusive behaviour toward staff, delivery personnel, or other customers
• Use automated tools (bots, scrapers) to access the Service without written permission

10. Allergens & Dietary Information

While we make reasonable efforts to provide accurate allergen and dietary information, we cannot guarantee that any menu item is completely free of allergens due to shared preparation environments. Customers with allergies or dietary restrictions assume all risk and should contact us directly before ordering if in doubt.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Buzz Treats - Spiked Scoops & Frosted Shaves, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of profits, data, or goodwill, service interruptions, delivery delays, food-related illness, or errors in pricing or menu content.

Our total aggregate liability for any claim arising from or relating to these Terms or the Service shall not exceed the amount you paid for the specific order giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Buzz Treats - Spiked Scoops & Frosted Shaves and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Dispute Resolution

Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (or equivalent body in your jurisdiction), conducted in TX. You agree that any proceedings shall be conducted on an individual basis and not as a class action.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of TX, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the courts located in TX.

15. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
